Garantía Limitada:
At Owlet Baby Care, Inc., we warrant that if you use our products as they are intended, our products will be free from defects in materials and workmanship for the following periods:
Original Electronic Products: 1 year from the date of registration for new products and 6 months for refurbished products (refurbished products may not be available in all areas).
Replacement Electronic Products: 6 months from the date of purchase for any replacement electronic products purchased from Owletcare.com, including replacement sensors.
Non-Electronic Products: 30 days from the date of purchase.
Customers in some jurisdictions may have additional rights under applicable national legislation. For example, customers in the European Economic Area are entitled to a 2 year warranty against defects in materials and workmanship from the date of purchase. Customers in Australia are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage under the Australian Consumer Law or national laws implementing EC Directive 99/44. Australian customers are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. This limited warranty does not affect any such rights. For a full understanding of your rights, you should consult the laws of your country, State or province.
We do not warrant our products against general wear and tear or damage as a result of misuse, modifications or improper maintenance.
If you believe you have received a defective product, we will either repair or replace, at our option, the defective product or its defective component part(s) in accordance with the terms of this limited warranty. We warrant the replacement for the remaining unexpired period of the original product’s warranty.
This limited warranty applies only to the original purchaser of the product. Our products are legitimately sold only by us and our authorized sellers who are required to follow our policies, procedures, and quality control standards. Because Owlet cannot control the quality of products sold by unauthorized sellers, this limited warranty applies only to products that were purchased from Owlet or one of our authorized sellers, unless otherwise prohibited by law. We reserve the right to reject warranty claims for products purchased from unauthorized sellers, including unauthorized websites. This limited warranty does not warrant that the operation of the product will be uninterrupted or error-free.
Please note: This limited warranty is the only warranty we offer for our products.
We limit the applicability of implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, to the duration of this limited warranty. To the extent permitted by law, we disclaim all other warranties of any kind. Some States, provinces and countries do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
Our sole liability for any defect shall be as set forth in this limited warranty and excludes any claims for incidental or consequential damages. Some States, provinces and countries do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. No person or entity is authorized to make any other warranty on our behalf. This warranty gives you specific legal rights, and you may also have other rights which vary from State to State, province to province, and country to country.
Retracto de Compra:
Según el artículo 47 de la Ley 1480 del Estatuto del Consumidor, el derecho de retracto en Colombia se aplica en las siguientes situaciones:
- Ventas a distancia realizadas por internet, catálogos, bolsa de valores, etc.
- La venta de plazos compartidos.
- La venta de bienes o servicios utilizando métodos de financiación que el vendedor pone a disposición. Por ejemplo, la venta de un producto a plazos.
- Las ventas realizadas a través de canales no tradicionales (productos apoyados con invitaciones o regalos, etc.) (Superintendencia de Industria y Comercio, sentencia 7772-21 de 2021).
"Artículo 47. Retracto. En todos los contratos para la venta de bienes y prestación de servicios mediante sistemas de financiación otorgada por el productor o proveedor, venta de tiempos compartidos o ventas que utilizan métodos no tradicionales o a distancia, que por su naturaleza no deban consumirse o no hayan comenzado a ejecutarse antes de cinco (5) días, se entenderá pactado el derecho de retracto por parte del consumidor. En el evento en que se haga uso de la facultad de retracto, se resolverá el contrato y se deberá reintegrar el dinero que el consumidor hubiese pagado." [...] Artículo 47 de la Ley 1480 del Estatuto del Consumidor
El único requisito para hacer uso del derecho de retracto es informar al vendedor o proveedor del deseo de hacer el retracto. Esto deberá hacerse dentro de los cinco días hábiles siguientes a la entrega del producto. La forma óptima de manejar esta notificación es por escrito para que todos estén al tanto de la fecha en que se cumplió la solicitud.
Al solicitar el derecho de cancelación, el vendedor debe devolver cualquier dinero pagado libre de retenciones de manera oportuna dentro de los siguientes 30 días a partir de la fecha de la solicitud.
Devoluciones:
Escríbenos un mensaje con tu solicitud a través del formulario de contacto o al correo electrónico happylife@provetecmar.com indicando la razón de tu solicitud de devolución:
1 - Defecto de fabricación
2 - Retracto de compra
3 - Otro
Tu solicitud será verificada en un plazo de 5 días hábiles y te enviaremos una respuesta con las instrucciones a tu correo electrónico.
En caso de solicitar devolución por Retracto de Compra, el producto debe estar en perfectas condiciones con su empaque original.
En caso de solicitar devolución por Defecto de Fabricación, te enviaremos las instrucciones de envío con un código RMA.
